MANDATED REPORTING
IF YOU RUN INTO A MANDATED REPORTING SITUATION:
Report concern to an FSL or school counselor as soon as possible � this would preferably be done before school releases that day in case the student needs to be contacted before going home
If you are unable to locate an FSL or school counselor, report concern to an administrator
It will then be determined if a hotline is necessary and who will call it in
- Any physical
injury, sexual abuse, or emotional abuse inflicted on a child other than
by accidental means by an adult (can include minors inflicting injury).
Discipline, including spanking, administered in a reasonable manner is not
considered abuse.
Neglect
- Failure to
provide the proper and necessary support, education (as required by law),
nutrition or medical, surgical, or any other care necessary for the
child�s well-being.
Probable
Cause
- Available facts,
when viewed in light of the surrounding circumstances, which would cause a
person to believe a child was abused or neglected. But remember it is the
duty of the Children�s Division investigator to determine if abuse and/or
neglect is occurring.

- Other school
officials
- Health care
professionals
- Day care
providers
- Social Workers
- Law enforcement
officers
- Other persons
with responsibility for the care of children
How
do I report suspected abuse or neglect?
- Missouri�s Child
Abuse/Neglect Hotline 1-800-392-3738
- Be ready to
provide the name and address of the child, and the name of the child�s
parents
- Also provide the
age, race, and sex of the child
- Nature and
extent of the injury or neglect
- Names and
address of the person responsible for the injuries or neglect
- Possible hazards
in the home (guns, dogs, drugs, etc.)
- Remember, not
all hotlines are accepted. It is ok to call the hotline to ask questions
and check if they would accept the concern.
What
is Missouri�s law on Mandated Reporting?
- If you have
probable cause to suspect that a child has been or may be subjected to
abuse or neglect, you must immediately report or cause a report to be made
to the hotline.
- Failure to
report is a Class A Misdemeanor
- Any person who
complies with Missouri law relating to the reporting of child
abuse/neglect is immune from civil or criminal liability unless that
person filed a false report
- Missouri law
requires that investigators contact the mandated reporter within 48 hours
of receipt of the report to ensure that full information has been received
and to obtain any further information.
- The law does not
require the reporter to leave his/her name and contact information, but it
can be helpful during the investigation process.
